Legal entity – The full official name, legal address Natural person – The Name (as it is in the passport), address. Representation by a trademark attorney Foreign applicants must perform the trademark prosecution in Turkmenistan through an agent, a registered in Turkmenistan trademark attorney. Opposition  period against trademark application in Turkmenistan may be filed within the whole term of examination, provided that official fee is paid. Priority document Certified copy of priority document if priority is to be claimed (may be filed to the Turkmen Trademark Office within three months from the filing date.

Signed Power of Attorney, legalization and notarization are not required (may be filed to the Turkmen Trademark Office within two months from the filing date

General information

Invention

  • Procedure

Registration period – about 3-5 years from application filing date.

Proof of registration – Certificate.

Term of validity – 20 years from application filing date. Patent for invention can be extended for additional 5 years if the object of the patent is the medicinal product, pesticide or agrochemical, when use of product requires permission of competent authority.

What can be protected: product (device, substance, microorganism strain, plant and animal cell culture, etc.); new use of known device, process, substance, strain.

3. Number of International publication (PCT procedure) or Application materials: claims, description, abstract, drawings (non-PCT procedure; international application wasn’t published).

4. Turkmen or Russian translation of the application (we prepare by ourselves).

5. POA (no legalization or notarization required).

6. Certified copy of the priority application (if priority is claimed).

Representation by the invention attorney: Foreign applicants must perform the invention prosecution in Turkmenistan through an agent, a registered in Turkmenistan invention attorney.

POA and Turkmen translation of the application must be submitted within 2 months from the date of filing.

Priority documents must be submitted within 3 months from the date of filing.

Original of the POA signed by applicant(s). Notarization or Legalization is not required.
In accordance with acting Turkmenistan legislation, objects of copyright are: Literary works; Dramatics or musical dramatics, choreography, pantomimes and other works; Musical works; Audiovisual works; Sculptures, pictorial art, graphics, lithographic and other works of fine arts; Arts and crafts, and works of monumental arts; Works of architectural, urban planning and garden art; Photographic or similar works; Maps, plans, design sketches, illustrations and other similar works relating geography, topography and other sciences; Derived works including translations, processing, and other revisions of science, literature and art works; collections such as encyclopedias and databases; and other compound works are also objects of copyright. The procedure of copyright registration in Turkmenistan usually takes about 2-3 months.
  The general requirements for filing a copyright work are:

  1. Full name(s), address(es) and the date of birth(s) of the author(s);
  2. Full name(s), address(es) of the Right holder(s) (if differs from author);
  3. Title of the copyright work;
  4. Date of the creation of the work;
  5. A copy of the work in a material form printed or presented as computer file (if computer programs – in their initial form)

A simply signed power of attorney is needed.
