Kyrgyzstan

 

General information

Invention

Registration period – about 2-4 years from the application filing date.

Confirmation document – Certificate.

Term of validity – 20 years from the application filing date. Patent for invention can be extended for additional 5 years if the patent object is a medicinal product, pesticide or agrochemical, or when the product use requires permission of the competent authority.

What can be protected: product (device, substance, microorganism strain, plant and animal cell culture, etc.); method (process of affecting material object with material resources), including use of the product or method for the specific purpose (for example, for treating diseases).

Utility model

Registration period – about 12-18 months from the application filing date.

Confirmation document – Certificate.

Term of validity – 8 years from the application filing date.

What can be protected: device.

5. Power of Attorney (no legalization or notarization required) must be submitted within 2 months from the date of filing.
6. Certified copy of the priority application (if priority is claimed) must be submitted within 16 months from the date of filing.

Confirmation document – Certificate of industrial design.

Validity period – 10 years with a possible extension of the term for no more than 5 years.

What can be protected as an industrial design: decorative or aesthetic aspect (design) of products – a wide variety of industrial or artisanal products.

Official language – application materials are submitted in Kyrgyz or Russian and all prosecution is conducted in Kyrgyz or Russian.

Requirements

1. Information about the applicant – full name / address of permanent residence, name of the legal entity / address of registration of the legal entity.

2. Information about the author(s) – full name, address of permanent residence.

3. A set of images of the product, that gives a complete and detailed understanding of its appearance; drawing of the general appearance of the product, ergonomic diagram, assembly map, if they are necessary for disclosure of the essence of the industrial design.

4. Power of attorney for a representative in intellectual property.

5. Priority claim with reference to the date of the previous application filing and previous application number, and a copy of the previous application and its translation into Kyrgyz and Russian languages (if priority is established).

6. A document confirming the display of an industrial design at exhibitions held on the territory of a state that is a participant of the Paris Convention.
