Ukrpatent informs that due to regulatory works, the filing of applications using the SEV-ZES, SPEZ-1, SPEZ-2 (СЕВ-ЗЕС, СПЕЗ-1, СПЕЗ-2) and e-mail systems has been temporarily suspended. For the time being, applications for intellectual property objects are suggested to be submitted in paper form at the following address: str. Glazunova, 1, Kyiv city, 01601.

The implementation of regulatory works is due to the changes that are currently taking place in the state intellectual property system, namely the transfer of the functions of the National Intellectual Property Authority (NIPA) from the “Ukrainian Intellectual Property Institute” (Ukrpatent) to the “Ukrainian National Office of Intellectual Property and Innovation” (UKRNOIPI) according to the order of the Cabinet of Ministers of Ukraine dated October 28, 2022 No. 943-r “Some issues of the National Intellectual Property Authority”.

Be reminded that the reform of the state system of intellectual property has begun in 2016. One of the stages was the adoption of Law No. 703-IX and the creation of the National Intellectual Property Authority (NIPA).

According to the Law, the functions of the IP are performed by a legal entity under public law (state organization), established by the central executive body, which ensures the formation and implementation of state policy in the field of intellectual property, and is determined by the Cabinet of Ministers of Ukraine. Until now, the functions of this body were temporarily entrusted to Ukrpatent. In this regard, the Cabinet of Ministers of Ukraine identified the state organization “Ukrainian National Office of Intellectual Property and Innovation” (UKRNOIPI) as the entity performing the functions of IP, and terminated their performance by the state enterprise “Ukrainian Intellectual Property Institute ” (Ukrpatent).

The transfer of NIPA functions from Ukrpatent to UKRNOIPI is an expected and legislated step in the implementation of the reform of the institutional component of the state intellectual property system. UKRNOIPI acquired the powers of NIPA on November 8, 2022.
