Procedure features:

More than 135 000 TMs are registered in EUIPO every year . Therefore, a trade mark should be registered for exact goods and services you work with (not for all in class). It allows saving time and money for oppositions and goods/services limitations.

The goods and services should be specified as accurately and precisely as possible.

Registration period – about 10 months from the application filing date.

Invention

Registration period – about 2-6 years from the application filing date.

Confirmation document – Certificate.

Term of validity – 20 years from the application filing date. Patent for invention can be extended in the Contracting State whose legislation provides the extension of the validity of the national patent for an invention.

What can be protected: device, method (process), substance, biotechnological product, usage of the device, method, substance, biotechnological product (use of the object for a new purpose).

Requirements

1. Applicant information – full name / title and registered office.
2. Inventor information – full name and registration address.
3. Number of International publication (for PCT procedure) or application materials: claims, description, abstract, drawings (for non-PCT procedure; international application was not published).
4. Translation of the application into English, French or German (we prepare by ourselves) must be submitted within 2 months from the date of filing for non-PCT procedure and within 31 months from the priority date for PCT-procedure.
5. Power of Attorney (no legalization or notarization required) must be submitted within 2 months from the date of filing.
6. Certified copy of the priority application (if priority is claimed) must be submitted within 16 months from the date of filing.

Europe

 

General information

Registration period – within 10 working days or more.

Confirmation document – Electronic certificate of industrial design.

Validity period – 5 years from the priority date, and it can be renewed for a five-year period four times, providing a maximum duration of protection of 25 years.

What can be protected as an industrial design: the appearance of the whole or a part of a product resulting from the features of, in particular, the lines, contours, colours, shape, texture and/or materials of the product itself and/or its ornamentation.

Official languages – application materials are to be submitted in English, French, German, Italian or Spanish.

Specific feature of the procedure 1 – the applications will be assessed only in relation to formal requirements, i.e. whether the application relates to a design in general and whether the design is contrary to public policy or is contrary to accepted principles of morality.

Specific feature of the procedure 2 – the applicants are able to request a postponement of the publication of the designs for a period of up to 30 months from the priority date.

Notification of registration of renewal fees

Requirements

1. Information about the applicant – full name / address of permanent residence, name of the legal entity / address of registration of the legal entity.

2. Information about the designer(s) – full name, address of permanent residence.

3. A representation of the design suitable for reproduction or a specimen.

4. An indication of the products in which the design is intended to be incorporated or to which it is intended to be applied.

5. Power of attorney for a representative in intellectual property (no legalization or notarization required).

6. The citation of the designer or of the team of designers or a statement under the applicant’s responsibility that the designer or the team of designers has waived the right to be cited.

7. Priority claim with reference to the filing date, the number of the previous application and the name of the country or institution where it was submitted, as well as a certified copy of the previous application issued by the institution that received it (if priority is established).

8. A declaration that exhibition priority is claimed, stating the name of the exhibition and the date of the first disclosure of the products in which the design is incorporated or to which it is applied (if exhibition priority is established).
